General Conditions
Scope of the conditions
These general conditions apply to all business relations between the customer and ichtira'm b.v. (in this text ichtira'm), concerning the products which are offered by ichtira'm and purchased by the customer by means of the Internet site of ichtira'm. In case of a dispute this is settled in a Dutch court according to Dutch Law, and is presented to the designated judge in Amsterdam, the Netherlands.
Exceptions on these general conditions are only valid if these are accepted in writing by ichtira'm.
Contract
Orders which are placed by the customer on the internet sites of ichtira'm ( .com, .nl, .it, .de, .fr, .co.uk, in this text the Internet site) for products which are offered by ichtira'm are considered as an intention to conclude a sales contract. This intention to conclude a sales contract is confirmed by ichtira’m by an e-mail. A second e-mail of ichtira'm confirms conclusion of the sales contract.
Ichtira'm sometimes uses the services of third parties for execution of the obligations which result from a sales contract.
Ichtira'm has the right to refuse an order. If ichtira'm doesn’t send an affirmative e-mail within 14 days after the order is placed and the customer has paid, the order can be considered as refused. In this case or when ichtira'm cannot comply with the obligations in the sales contract, ichtira'm will perform a complete refund to the customer.
Information
All information provided by means of the Internet site, e-mail or by telephone, will be as accurate as possible. Additional information is on demand at: info@ichtiram.com.
Delivery dates are only indicative and may differ from reality. Pictures of the products which are shown on the Internet site, are illustrative only. The customer cannot derive any rights from this information.
Price of the products, additional costs
The price of a product, as shown on the Internet site is in euros, including VAT for all countries of the European Union, but excluding costs for delivery. During the ordering process on the Internet site, the customer is informed about the costs for delivery, which are added on top of the purchase price. If there are any additional costs, as customs tax, these are paid by ichtira'm within the European Union. Outside the European Union, these additional costs as customs tax have to be paid by the customer. Payment can be performed by means of electronic ways (iDeal) or credit card.
Ichtira'm has the right to modify the price of a product that is offered at any moment. Of course, the price of a product that is ordered and paid for will remain unchanged during execution of the obligations of the sales contract.
Quality & guarantee
Ichtira’m spends the highest possible care its products in design, production and transport. Ichtira´m doesn´t make any concessions to the quality of the products. Information on the used materials and measurement specifications, as well as detailed photograph's are available on the Internet site, additional information is on demand at: info@ichtiram.com.
If a product shows any defects at receipt, the customer should file a complaint within 2 months by means of e-mail to: info@ichtiram.com or in writing to ichtira'm b.v., postbus 45, 5600AA, Eindhoven, the Netherlands.
Dissolution of the sales contract
The customer has the right to dissolve the sales contract unilaterally under the conditions listed below:
- The customer is not obliged to give a reason for dissolution of the sales contract.
- Dissolution is announced in writing by the customer within14 days after receipt of the products to ichtira'm. Also the products must be returned as soon as possible, but at the latest within 14 days after receipt.
- During the period in which dissolution is possible the customer will handle the product and packing carefully. The customer will only unpack the product as far as necessary to be able to assess if he wishes to keep the product.
- The products must be sent unharmed in their original packing to: ichtira'm b.v., postbus 45, 5600AA, Eindhoven, the Netherlands.
- Products must be in good state. Products which are damaged during the period that these were in possession of the customer or during transport to ichtira'm, do not qualify for complete refund. Ichtira'm has the right to diminish the refund in case of damage of the product. Of course, damage of packing at unpacking the product by the customer, will not diminish the refund.
- If the above conditions have been met, refund of advance payment will take place, depending on the state in which the product is sent back.
- If the product is sent back in impeccable state, the customer must only pay the costs of the transport back to ichtira'm.
- Refund takes place within 30 days after receipt of the sent-back product by ichtira'm.
Delivery
Delivery of products will be at the address which is given by the customer. Sometimes, in case of multiple ordered products, not all products are delivered at the same time. Delivery takes place within 30 days after payment. If a product is not on stock, it is possible that the delivery period is extended with another 30 days. The customer receives a notification of this event. If a customer in this case decides to cancel the sales contract, refund of money that is already paid by the customer, will take place within 30 days.
Methods of payment
Products can be paid by means of the credit cards of: American Express, MasterCard or VISA, as well as by means of electronic banking. As soon as the complete charged amount has been transferred by the customer, the order will be handled.
As long as the complete charged amount has not yet been paid, the sales contract will not be confirmed. If the period between placement of an order on the Internet site and complete payment exceeds 14 days, the order will not be confirmed and any incomplete advance payment will be refunded.
Maintenance of products
Maintenance and washing instructions can be found on the label of the product. Ichtira´m takes no responsibility for damage which has arisen by wear or incorrect treatment of the product.
Liability
Up to the moment of delivery at the address of the customer, ichtira´m is responsible for the quality of the products.
Ichtira'm is not responsible for consequential damage in whatever form, directly or indirectly the consequence of damage of/ to/ by products of ichtira'm.
In all cases in which ichtira’m is obliged to pay compensation for damage, in whatever form, this will never be more than the purchase amount of the product which has been damaged or involved in damage.
Every claim to ichtira’m has to be submitted in writing to ichtira’m within 30 days as from the moment that the claim arose. Only a claim that has occurred within 6 months after delivery of the product possibly qualifies for compensation.
Force Majeure
Ichtira’m is authorized to call upon force majeure at the settlement of the sales contract, either whole, or partially, either temporary or definitive, if ichtira’m is hindered by circumstances which are not attributable to ichtira’m. This can concern delay or damage of products, caused by for example: fire in productions or storage facility, blockade, strike, customs authorities, raw material suppliers, accidents, measures of the government such as a transport, imports or production prohibition, natural disasters, subcontractors negligence, etc.
In case of force majeure, the obligations of ichtira’m are suspended. In case the suspension lasts longer lasts than 3 months, the customer is entitled to dissolve the purchase contract unilaterally and the amount already paid can be claimed.
Privacy
Your personal data are stored in the ichtira'm customer file. Your data are used for the processing of your order and managing your customer relation with ichtira'm. Ichtira'm does not supply data to third parties, except for the implementation of the obligations which result from the sales contract.
Intellectual property
The customer recognises that ichtira’m is the sole and legitimate owner of the trade names, the registered and unregistered designs, the patents and copyright, the contents and rights of the database, domain names and concepts. The customer does not take over any property rights at any time. The customer cannot claim any rights or property concerning ichtira’m.

If you, as a customer, have complaints concerning any component of the sales contract, the Internet site or the products of ichtira'm, you can address these to: ichtira'm b.v., postbus 45, 5600AA, Eindhoven, the Netherlands. Also a complaint can be addressed by means of e-mail to: info@ichtiram.com. Complaints are answered within 3 weeks after reception.
